Tend Terms of Service

These Terms of Service ("Terms") are an agreement between you and Empty Bar LLC, a Minnesota limited liability company ("Empty Bar," "we," "us"), which makes Tend. Questions any time at tend@emptybar.app.

Tend is a calendar, a set of lists and a kitchen screen for a household, along with records about the house itself. It runs on phones and on a screen you hang on a wall.

By creating a Tend account, downloading the app, or using Tend, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Tend.

1. Who can use Tend

You must be at least 13 years old to hold a Tend account. If you are between 13 and the age of majority where you live, you may only use Tend with the consent of a parent or guardian who agrees to these Terms on your behalf.

Children in a household are profiles that an adult creates and controls. A child does not hold an account and does not agree to these Terms. Section 4 covers what that means.

2. Your account

You are responsible for what happens on your account, for keeping your login secure, and for the accuracy of what you enter. If you think somebody else has reached your account, email tend@emptybar.app.

3. Households

A household is the unit Tend is built around. Almost everything in Tend belongs to a household rather than to one person.

Shared by design. Every adult member of a household can see and change the household's calendar, lists, chores, photographs, board, and the home records attached to it. There is no per-item privacy setting. Do not put something in Tend that you would not want another adult in your household to read.

What you bring, and what stays. When you join a household, the people in it get access to what you bring. When you leave, you keep your home profile and the records attached to it: appliances, projects, vendors, reminders, documents, invoices, inspection reports and your conversations with the assistant. You lose access to everything shared. Anything you created that belongs to the household stays with the household, including photographs you added, lists and events you made, and notes you posted to the board.

Leaving. Any member can leave. An owner of a household with other people in it has to transfer ownership before they can leave. There is no way to remove somebody else from a household.

Transferring ownership moves the owner role and nothing else. No data changes hands. The previous owner remains a member.

Deleting your account deletes the whole household if you are the last member of it. If anyone else is still in the household, the household and its shared content stay and only what is personally yours is removed. Section 13 and the Privacy Policy say exactly what goes.

Invitations. Do not invite somebody into your household unless you are willing for them to see everything in it, including what other members put there.

4. Children in a household

An adult sets up a child's profile, and the adults in the household are responsible for that child's use of Tend, including anything they do on a kitchen screen.

A child can tap their own face on a screen, see the jobs assigned to them, mark a job done, and ask to spend what they have earned. A child cannot approve their own request. Only an adult, on a phone, can approve it.

Anything Tend tracks for a child, including chores, what a chore is worth and what a child has saved, is a household bookkeeping tool between you and your child. It is not money, not a stored balance, not a financial product, and not redeemable for anything from us. What a "gem" or whatever you call it is worth, and whether you honour it, is entirely between you and your child.

5. Your content

You keep ownership of everything you put into Tend: your calendar, lists, chores, photographs, messages, home records, documents and chat.

To run Tend you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display that content for the purpose of operating, maintaining, securing and improving Tend for you and for the household you are in. The licence ends when the content is deleted or the account is closed, except where we have to keep a copy for legal, backup or security reasons.

We do not sell your content. We do not use it to train AI models. We do not show it to advertisers. Tend has no advertising.

Photographs of other people. When you upload a photograph of somebody else, including a child, you are saying you have the right to do that. Photographs placed on the screensaver are shown full-screen on any screen paired to your household, to whoever is standing in front of it.

6. Screens

A kitchen screen that you pair to your household is part of your household and your responsibility.

When you pair a screen, we create a login that belongs to that screen, not to any person. That login stays on the device until you remove the screen from your phone, which deletes it.

You are responsible for where you put a screen and who can reach it. A screen shows your household's names, week, lists, board and photographs to anybody in front of it, and it requires no password to look at. A screen can add a list item, tick something off, mark a chore done and post a note. It cannot delete anything, approve spending, or see any other household.

Remove a screen from your phone before you sell, give away or discard the device. Removing it deletes the screen's login on our side. It does not erase what the device's own browser has cached, so wipe the device as well.

7. The assistant

Tend has an assistant that answers questions and files things for you. It is provided "AS-IS" and "AS-AVAILABLE," with no warranty of any kind.

What you send it, and where that goes, is described in the Privacy Policy.

8. Subscriptions and payment

Tend offers a paid tier, Tend Pro, monthly or annual.

What is free. An account, your household, the calendar, lists, chores and the kids' side, the kitchen screen, photographs, the board, messages, your home profile and records, documents, reminders, the care plan, and an export of your record. These are the parts most people use most, and they are free. Syncing your Tend calendar out to an outside calendar app is part of Pro.

What Pro is for. Tend Pro exists for the parts that cost us money to run, which is mostly the assistant, and for a handful of features built on it. We list what is included on the paywall in the app, and we may change that list. Some features that are free today may become paid, and some that are paid may become free.

Assistant usage. A free account gets five assistant messages a month. Tend Pro includes 500 a month. Both counts start fresh on the first of the month. The 500 is a fair-use limit meant to stop automated or abnormal use, not a meter you are expected to watch. If you are doing something ordinary and you reach it, email us.

Where you pay. Subscriptions are bought and managed through your Apple App Store or Google Play account, not through us. Payment, billing, tax, currency and receipts are handled by Apple or Google under their terms.

Free trial. We may offer a free trial on some plans, in some countries, to people who have not had one before. Whether a trial is available to you is determined by Apple or Google, not by us. If a trial is offered and you do not cancel before it ends, it converts to a paid subscription at the price shown.

Auto-renewal. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. Manage or cancel in your App Store or Google Play account settings.

Price changes. We may change the price for future periods. We will tell you beforehand and, where the law requires it, give you a chance to accept or cancel.

Who a subscription belongs to. A subscription belongs to the account that bought it, not to the household.

10. Third-party services

Tend runs on services provided by other companies. The current list, and what each receives, is in the Privacy Policy. It includes Supabase, Anthropic, Apple, Google, RevenueCat, Expo, PostHog, Cloudflare, Open-Meteo and Resend. Your use of Tend is also subject to their terms where relevant. We are not responsible for their availability, accuracy or content.

Links and suggestions in Tend, including suggested local businesses and product links, are for convenience. Some product links are affiliate links and we may earn a commission. We do not endorse, verify or take responsibility for third-party businesses, sites, products or services.

11. Intellectual property

The Tend name, logo, brand, design, software, copy and original content, other than your content, belong to Empty Bar LLC and are protected by copyright, trademark and other laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app as these Terms intend. No other rights are granted.

12. Beta features and changes

We release early features sometimes. They may be unstable, change without notice, or disappear. We may change, suspend or discontinue any part of Tend. We will give reasonable notice of a major change that materially affects paid subscribers.

13. Ending it

You can stop using Tend at any time. You can delete your account in the app under You, then Account options, or by emailing tend@emptybar.app.

Deleting your account removes your login, your home and the records attached to it, your conversations with the assistant and your stored files.

What happens to the household depends on who is left in it. If other members remain, the household and its shared content stay with them and only what is personally yours is removed. If you are the last member, the household goes too, and so does everything in it: the calendar, the shared lists, the chores, the board, the family photographs, the profiles of any children in it, and any screen paired to it, which is signed out and cannot be paired again. That is final and we cannot recover it.

The Privacy Policy lists exactly what goes and what stays.

We may suspend or end your access, with or without notice, if we believe you have broken these Terms, if the law requires it, or if continuing to serve you creates legal or security risk for us or for other people. If we end your access while you have an active paid subscription, we may refund the unused part at our discretion, unless we ended it for cause.

Sections that should outlast the agreement do: 5 (licence to content), 7 (the assistant), 11 (intellectual property), 14 (disclaimers), 15 (limitation of liability), 16 (governing law), and this sentence.

14. Disclaimers

To the fullest extent the law allows, Tend and everything in it, including the assistant's output, is provided "AS-IS" and "AS-AVAILABLE," with no warranties of any kind, express, implied or statutory. That includes any implied warranty of merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, or accuracy of anything the assistant produces.

We do not guarantee that Tend will be available at any particular moment, that data will never be lost, or that what it tells you will be correct. A kitchen screen depends on your own network, your own device and your own power, none of which we control.

15. Limitation of liability

To the fullest extent the law allows:

Some places do not allow these exclusions. Where that is so, our liability is limited to the least the law allows.

16. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts in Minnesota, and you consent to their jurisdiction. If you are a consumer somewhere whose law requires a different forum or law, that law applies to the extent it must.

Before filing a formal claim, contact tend@emptybar.app and give us 30 days to try to sort it out.

There is no arbitration clause and no class-action waiver in these Terms. That is deliberate. You keep the right to bring a claim in court.

If you got Tend from Google Play, your use is also subject to the Google Play Terms of Service. Purchases and refunds for Android are handled under Google Play's policies.

19. Changes to these Terms

We may update these Terms, for example when we add features or when the law changes. When a change is material we will tell you in the app, by email, or both, and update the date at the top. Continuing to use Tend after a change means you accept it. If you do not, stop using Tend and, if you subscribe, cancel through Apple or Google.
